SKETCHPAD FIELD TEST EDITION SOFTWARE USAGE AGREEMENT

This agreement applies only to this Field Test Edition of The Geometer’s Sketchpad and to no other software.

GRANT OF USAGE RIGHTS

As a field tester, you have the limited, non-exclusive right to download, copy and use this product on one or more computers, and to allow your students, colleagues, and collaborators equally to use this software in ways that support your field test evaluation of the software. You may download from-time-to-time improved versions of the field test software from the Sketchpad Field Test website and circulate that URL among students, colleagues, and collaborators for similar purpose, and you are encouraged to share appropriate field test feedback as directed by the instructions on that website. All other rights are expressly reserved by their respective rights holders.

LIMITED WARRANTY

THE SOFTWARE IS PROVIDED ‘AS IS’ WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE PRODUCT, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES. USERS EXPLICITLY ACKNOWLEGE THAT AS FIELD TEST SOFTWARE, IT MAY CONTAIN KNOWN DEFECTS OR UNKNOWN DEFECTS WITH CONSEQUENT USAGE RISKS.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SKETCHPAD FIELD TEST OR ITS PARTNERS, SUPPORTS, OR AFFILIATES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES.
